Closed Meeting Affidavit
A district board may enter a closed meeting from a properly noticed open meeting. Upon a board-member motion to enter a closed meeting as noted on the open meeting agenda, the board may enter a closed meeting, providing that 2/3rds of board members present vote in favor of the motion to enter a closed meeting for the purpose of discussing any of the purposes provided in statute. The Closed Meeting Affidavit must be used to indicate that a closed meeting was to be held to discuss:
- The character, health, or competence, of an individual, or
- The deployment of security devices, personnel, or systems.
In this case, the proceedings of the closed meeting to discuss either of these two items does not need to be recorded. However, the affidavit must be completed, notarized, and retained with the Open Meeting Minutes associated with the closed meeting.

For all other purpose provided in statute for which a board convenes a closed meeting, the proceedings of the closed meeting must be electronically recorded, and the recording must be permanently retained by the government entity as a protected record.
